In these general terms and conditions, the following is understood to mean:
These general terms and conditions apply to all offers, bookings, agreements, and participations with FancyCarTours.
A booking is final after FancyCarTours has confirmed the registration and the any deposit due or full payment has been received.
Payment must be made within the period set by FancyCarTours. If payment is not received, FancyCarTours reserves the right to cancel the booking or refuse participation.
FancyCarTours reserves the right to cancel, reschedule, or modify a tour or event in the event of insufficient participation, force majeure, unforeseen circumstances, or other reasonable causes.
In that case, FancyCarTours will endeavor to offer a suitable alternative or refund amounts already paid for the unperformed part.
Participation in a FancyCarTours tour or event is entirely at your own risk. The participant is personally responsible for his or her conduct, vehicle, travel documents, insurance, and driving fitness.
The participant must be in possession of a valid driver's license and a sound, car suitable for participation. The participant is also responsible for valid insurance for the vehicle used for participation.
FancyCarTours is not liable for any damage, direct or indirect, including but not limited to damage to vehicles, personal injury, consequential damage, financial loss, theft, loss, delays, fines, or other damage arising during or in connection with participation in a tour or event.
Every participant takes part at their own risk and remains personally responsible at all times for complying with applicable traffic rules and local laws and regulations.
FancyCarTours compiles routes with the greatest possible care. Nevertheless, FancyCarTours cannot be held liable for any errors, inaccuracies, or incompleteness in routes, navigation files, or directions.
Any damage to vehicles or other consequences arising from following routes, directions, or advice from FancyCarTours are entirely at the participant's own expense and risk.
FancyCarTours reserves the right to exclude participants from participation or further participation in the event of dangerous, reckless, inappropriate, or disruptive behavior, or if instructions from the organization are not followed.
Exclusion does not entitle the participant to a refund of amounts already paid.
FancyCarTours compiles routes, hotels, restaurants, stops, and other components of the program with care. Nevertheless, routes, locations, or program components may change due to weather conditions, local circumstances, availability, or other causes.
In that case, FancyCarTours will offer an equivalent alternative where reasonably possible.
The participant takes part with their own vehicle and remains fully responsible for this vehicle at all times.
FancyCarTours is in no way liable for:
The participant declares that the vehicle is in good technical condition and is insured for at least third-party liability. FancyCarTours strongly advises participants to take out appropriate additional insurance.
The participant explicitly waives any right to compensation from FancyCarTours, whether direct or indirect, to the extent permitted by law.
Participants are not permitted to participate in driving activities while under the influence of alcohol, drugs, or other substances that affect driving ability.
FancyCarTours maintains a strict zero-tolerance policy regarding driving under the influence during all driving sessions.
If a participant is under the influence, exhibits dangerous driving behavior, or otherwise acts irresponsibly, FancyCarTours may immediately exclude this participant from further participation, without entitlement to a refund.
The participant remains personally responsible at all times for compliance with traffic rules, their own driving behavior, and any fines, sanctions, or criminal consequences.
With regard to hotels, restaurants, ferry companies, excursion providers, and other third parties, FancyCarTours acts solely as an organizer and/or intermediary.
FancyCarTours is not liable for shortcomings, errors, damage, loss, theft, injury, cancellations, or incidents caused by or arising at these external parties.
Any complaints or claims regarding services provided by third parties must be submitted directly to the relevant party.
During tours and events, photos, videos and other recordings may be taken by or on behalf of FancyCarTours.
By participating in an event or tour, the participant grants permission to FancyCarTours to use these images for promotional, commercial and editorial purposes, including publication on the website, social media, advertisements and other marketing material.
Participants may use photos and videos received or taken by themselves of an event or tour for personal use and on personal social media channels.
This also applies to images in which the participant's own vehicle is visible or which were taken by the participant themselves during the event.
It is expressly not permitted to use these images for:
Commercial activities also include: organizing, promoting, or offering similar tours, events, or driving experiences.
All content created by FancyCarTours, including photos, videos, texts, formats, route concepts, and promotional material, remains the property of FancyCarTours, unless otherwise agreed in writing.
In the event of a violation of this provision, FancyCarTours reserves the right to demand the removal of content and to recover any damages.
Force majeure includes, but is not limited to: extreme weather conditions, natural disasters, pandemics, strikes, war, government measures, road closures, technical malfunctions or other unforeseen circumstances beyond the reasonable control of FancyCarTours.
In the event of force majeure, FancyCarTours is not liable for damages or costs arising from changes, delays, or cancellations.
All agreements and legal relationships with FancyCarTours are governed exclusively by Dutch law.
Disputes shall be submitted to the competent court in the Netherlands, unless mandatory law provides otherwise.
By registering for a tour or event, the participant agrees to these general terms and conditions.
